Registration

The Register is a single national register for the whole of Spain but has a decentralised structure through the Regional Registers. The following cannot be registered in the Intellectual Property Register:

  • Ideas
  • Projects (with the exception of architectural and engineering works)
  • Inventions
  • Logos
  • Trade names, stage names, brand names or product names
  • Algorithms or mathematical concepts in themselves
  • Ideas or projects for television programmes (unless the formats are structured as such)
  • Legal provisions and their corresponding drafts; decisions of the courts and the acts, agreements, deliberations and opinions of public bodies, etc.

Registration of some of the above items must be carried out at the Spanish Patent and Trademark Office.

Procedure

In paper format:

It must be submitted bound or protected and stapled inside a plastic folder, cardboard folder, etc.

  • The work must be paginated and the cover must bear the full title and the first name and surname of the author or original owner.
  • The author or authors must sign the first and last pages.
  • If photographs are submitted, the title of the work and the author’s full name must be written on the back of each photograph.

In any other format:

  • It must be presented in a suitable protective case to prevent damage to the medium.
  • The author or authors must sign the medium itself.

In both cases, the following must be attached: a photocopy of the author’s or authors’ National Identity Card, official application forms, supplementary documentation (if required) and proof of payment of the fee.
